Superintendence Resolution Nº 000170-2021-MIGRACIONES, published last August 6, provides for the repeal of Superintendence Resolution Nº 000104-2020-MIGRACIONES (hereinafter, Resolution 104) and provides the following measures:

• Extension of term.-The term of temporary or resident migratory statuses granted from March 16, 2020, which expired during the validity of Resolution 104, is extended until the entry into force of this resolution.
• Resumption of the calculation of the term.-From August 16, 2021, the calculation of the term is resumed:

-The status of temporary and resident migratory, extended by Article 5 of Resolution 104; and,

– Authorizations to stay outside the country for 30, 183 or 365 calendar days, extended by Article 3 of Resolution 104.

• Migratory regularization.-

– Apply to foreigners with temporary migratory status whose term of stay has expired on March 15, 2020, the provisions of Article 220 of the Regulations of Legislative Decree No. 1350: “Foreigners with temporary migratory status who are in an irregular situation due to expiration of the term of stay, have a period of thirty (30) calendar days to regularize their migratory status“.

– The calculation of the fine for overstay shall be resumed on August 16, 2021 until the submission of the request for migratory regularization.

• Order to leave the country.-Grant a term of 15 calendar days from August 16, 2021, to foreigners who have an exit order pending execution due to the denial of their request for change or extension of their migratory status, in order for them to leave the national territory.
